Richard Caplan Solicitors have been struck off and ordered to pay costs of £ 21,000 having failed to maintain professional indemnity insurance for the firm as well as acting dishonestly.

The SDT noted that the respondent had on a previous occasion been found to have behaved in a manner unbefitting a solicitor and was not, therefore, of previous good character. More fundamentally, however, the SDT had made a finding of dishonesty, in relation to three allegations. There were no exceptional circumstances which could justify departing from the usual consequence of a finding of dishonesty, which was the imposition of a striking-off order.
